KC Software Company Sues JE Dunn Construction

Kansas City construction software company Marathon Reprographics Inc. claims in a lawsuit that JE Dunn Construction is using software that was built using information the general contractor took from Marathon. Marathon seeks damages of more than $25,000. JE Dunn, Kansas City’s largest general contractor, has not filed a response to the suit.

In 2008, Marathon and JE Dunn started working with a third-party software provider, to standardize processes — including project management, payroll, accounts payable, logistics and accounts receivable — throughout JE Dunn’s offices. JE Dunn went on to use the software on about 68 projects, according to the filing. In 2009, while the two parties still were operating under a joint venture partnership, JE Dunn allegedly developed a hidden objective to obtain as much useful and proprietary information from Marathon as possible to duplicate the functionality.
