Developer’s decision to abandon Kemper Arena project followed lawsuit threat

The decision by Foutch Brothers to scrap its plans for redeveloping Kansas City’s Kemper Arena came after the American Royal threatened a lawsuit.

In an Oct. 17 letter, an attorney representing the American Royal warned Foutch to “cease and desist” from its pursuit of historic designation for Kemper Arena.

The letter claimed that the development group’s efforts were detrimental to American Royal’s lease with the city of the American Royal Complex, which includes Kemper Arena. The lease lasts through 2045.

Foutch and the American Royal had rival plans for Kemper Arena, with the American Royal seeking to demolish the arena and replace it with a smaller multipurpose building and Foutch looking to keep the arena and turn it into a youth sports facility.
