Three pharmacies sue Express Scripts for denied claims

Three pharmacies are suing Express Scripts, the nation’s largest pharmacy benefit manager, for refusing coverage of compounded drugs.

The suit, filed by a trio of out-of-state pharmacies in U.S. District Court in St. Louis, alleges that Express Scripts has tried to reduce costs by denying payments to pharmacies for the blended drugs, which the lawsuit says were previously covered.

A lawyer representing the plaintiffs questioned whether employers are aware of these current denials or if the benefit plans were amended accordingly to reflect the denials of compound drugs.

Express Scripts recently posted a video on its website in which an executive explains how the company plans to decrease spending by excluding more than 1,000 ingredients whose prices “have been greatly inflated but that provide no additional clinical benefit.”
