Side Project Brewing, a small batch craft brewery in Maplewood, is suing The Modern Brewery for trademark infringement over the use of a lightbulb in a logo and other marketing materials.
In the lawsuit filed in federal court in St. Louis on Friday, Side Project’s founder and owner Cory King alleges The Modern Brewery craft brewery, which is located a few miles away in St. Louis, is infringing on its trademarks.
King alleges that when Side Project launched its marketing efforts with a Tweet that included the lightbulb in March 2013, The Modern Brewery’s owner Beamer Eisele came by the brewery where King was head brewer at the time, Perennial Artisan Ales. According to King, Eisele told him that he planned to use a lightbulb logo when he opened his new brewery. The Modern Brewery opened in 2014.
The Side Project’s trademark registration for a lightbulb logo design was filed with the U.S. Patent and Trademark Office in May 2013.
“People recognize our lightbulb, and it’s becoming more important than I ever thought,” King said of Side Project’s logo. “With a trademark, you have to defend it.”
