Judge dismisses one Schlitterbahn charge over mistake by AG’s office

A judge on Wednesday dismissed the criminal case against one of the defendants facing charges in the 2016 death of a 10-year-old boy at a waterpark in the Kansas City area.

Judge Robert Burns dropped charges against Schlitterbahn Waterpark of Kansas City, Kan., which was named as a defendant in a March indictment accusing the corporation and one of its employees of involuntary manslaughter and other charges.

There is no legal entity known as Schlitterbahn Waterpark of Kansas City, Kan.

The water park in question includes two legal entities: SVV 1, which owns the park’s land, and KC Waterpark Management, which operates the facility.

The Kansas Attorney General’s Office declined to answer questions after the hearing, but an attorney with the office said it would seek an indictment against the proper defendant.
