Missouri legislature passes medical malpractice caps

A bill that would bring back a cap for judgments in medical malpractice lawsuits has passed in both the Missouri House and Senate. The bill next goes to Governor Jay Nixon for final approval.

If passed, the bill would institute a cap of $400,000 for awards for “noneconomic damage” and $700,000 for wrongful death cases, with both receiving annual increases of 1.7 percent. Missouri currently has no limit in malpractice suits, as the Missouri Supreme Court previously eliminated them in 2012.
